China Proposes to Lighten Up Requirements for Cross-Border Data Transfers

Restrictions on cross-border data transfer have long been a cause for concern for foreign companies operating in China, and the Chinese regulators are seeking to address these concerns by lightening up the onerous requirements for cross-border data transfers.

On 28 September 2023, the Cyber Administration of China ("CAC") issued the Regulations for Standardizing and Promoting Cross-Border Data Flow ("Draft Regulations") to solicit public comments. The Draft Regulations appear to overturn some of their previous requirements in relation to cross-border data transfers. If adopted into law in its current form, the Draft Regulations would:

  • Create exemptions for many companies that export data or personal information from China in certain common business scenarios from otherwise mandatory data export approval procedures.

  • Raise the data transfer volume thresholds for the CAC's Security Assessment (a more onerous legal mechanism), and leave transfers of low-volume data to less onerous legal mechanisms. 

  • Allow free trade zones to create "Negative Lists" for cross-border data transfers that are subject to mandatory data export procedures.

Almost half a year has lapsed from the day that the Draft Regulations were publicized, many foreign companies are still waiting for the Draft Regulations to be formally issued. In an official press conference on 5 February 2024, the director of the Department of Foregin Investment Management under the Ministry of Commerce said that the Cyberspace Administration of China is contemplating and improving the Draft Regulations and preparing for its promulgation.

The EU-China Business Association and the European Union Chamber of Commerce in China will at this webinar focus on the results of the annual Business Confidence Survey 2022 of European Business in China. The survey was conducted by the European Union Chamber of Commerce in China.
 
Throughout 2021, the story of European business in China was one of high risks and high rewards. Revenue and profitability were positive but doing business in China also became more difficult for most companies.
 
As the rest of the world returns to a pre-pandemic level of normality — with few restrictions hampering business operations and travel — the role China played over the last two years in bolstering European companies’ global revenues looks set to diminish. 
 
At this event, European Chamber Vice President Bettina Schön-Behanzin will present the findings of this year’s survey.

There is an old saying that ”Those who owns the standards, owns the market”. It is therefore not surprising that China has made considerable efforts to increase its influence in standard setting in recent years with focus on future technologies as outlined in the CM2025 plan. We now not only have three competing systems (US, Europe and now China), in which Europe seems to lose ground, but with the further complication that Chinas approach to standardization is distinct from European and international practice. This webinar will among others cover China’s advances so far, Europe’s ambitions in this area and ends with a presentation of a foreign company’s ability to be involved in shaping technical standard setting in China. The webinar targets everyone interested in working with standards in China.

The presentation will be undertaken by Tim Rühlig, a research fellow at the German Council on foreign relations and an associate research fellow at the Swedish Institute of International Affairs, who together with the EU China Chamber of Commerce were the authors to “the shape of things to come: The Race to control - Technical Standardisation” as well as a joint presentation by Marie Skou, Head of Department and Pouline Terpager, Chief Consultant; both at Dansk Standard.

Overview of the Recent IP-Related Legal Developments in China

On October 17th 2020, the National People’s Congress Standing Committee approved the Patent Law amendment, which entered into force on 1st of June 2021. The key provisions of the new law include an increase in statutory damages, patent term restoration and a mechanism for early resolution of patent disputes in the pharmaceutical industry. Furthermore, the new law extends the design patent term from 10 to 15 years.

On November 11th 2020, the National People’s Congress Standing Committee approved the Copyright Law amendment, which entered into force on 1st of June 2021. The new copyright law expands the works protectable by copyright to adapt to the newest technological developments. It also increases statutory damages, authorises technological protection measures, reinforces the investigative powers of copyright authorities and shifts the burden of proof in infringement cases in favour of the right holder. During this online training, the Helpdesk provides an overview of these recent changes and explains what impact these changes can have for the SMEs. The online training will include a Q&A session at the end of the event allowing attendees to pose questions to the speaker.

This seminar attempts to offer a conceptual framework from a commercial perspective for solving such cases. The seminar will be illustrated with a case in point whose solution involved enforcement, or threatened enforcement, in China for the purpose of solving a commercial problem in the USA. Thus, the seminar will anchor its conceptual framework with a series of practical, low-cost, real-world actions.

Thomas is senior IP Strategist at AWA AB in Sweden. He holds several degrees, and he is in the final stages of completing his PhD in industrial management and economics. All his research has been focused on intellectual property.
